Serious Legal Question! Please help!
My mom and stepdad belong to a carclub that recently traveled to Portland, Oregon for a convention. While in the parking lot of the hotel my mom was mugged and had her purse stolen by some coward. He pushed her to the floor and ran off with her purse. My mom is ok but is still very shaken up. Since there was no security cameras or security guards at the time (9am) can the hotel be held responsible? Please note that the hotel, from what my parents told me, did little to nothing about the situation. Now since this happened out of state is there anything my parents laywer could do? My stepdad says that there is nothing the lawyer could do since this happened out of state. Is sueing an option since there was no security present at the time? Your advice will truely help us. Thanks!
The hotel could only be found negligent if they had knowledge that the parking lot was a dangerous area where crime is common. If nobody had ever been mugged there prior to your mother, then they would have had no reason to have security, and they would have no responsibility for what happened. If your mother wants to pursue this, she should contact an attorney in the state in which the hotel is located. But even with a lawsuit, the only possible damages would be for the contents of her purse, as you said she isn’t hurt. It doesn’t sound like it would be worth it.
