
red light/speed cameras and the right to face your accuser?
i was just wondering, how can you face your own accuser when your accuser is a speed camera or red light camera? isnt that unconstitutional if you can’t exersise your right to face your accuser?
Well, in my TX town they took down the red light cameras because the people issuing the tickets were not police officers, they actually worked for the vendor who provided the technology to take the pictures. Hence, it really wasn’t be done by sworn officers, and my town didn’t want to court fight, so they removed them. This is a big fight. You may want to start with your city council, state rep, and so forth. Find out first, who writes the citations. Good luck. In some places it’s not really a ticket, but a “civil fine” that means no points and it’s not really a criminal offense. Civil charges don’t have to meet the same constitutional requirements.
