What Responsibilities Does the Insurer Require When an Accident Occurs?
If the unfortunate happens and your motor vehicle is involved in an accident, certain steps are in place as provided by law and by the insurer. Knowing what steps you should take beforehand simplifies the process and alleviates a bit of the stress associated with being involved in a motor vehicle accident.
Legal Responsibilities
The Road Traffic Act (RTA) of 1988 clearly states that anyone involved in a motor vehicle accident must provide his name and contact information to anyone involved in the accident as well as to any police officers who are present. His certificate of insurance, as required by law, should also be offered for the other driver’s viewing.
Additionally, the driver should report the accident within a day’s time if no police officers are present at the scene of the accident. If an injury should be involved, the driver must report the accident to the police even sooner- within four hours of its occurrence. Of course, any driver involved in an accident is required by law to stop and complete all of these steps.
Insurer’s List of Responsibilities for Driver’s Involved in Motor Vehicle Accidents
Most insurers provide a list of specific requirements for drivers to follow if an accident occurs. Typically, this list includes all of the requirements set forth under the Road Traffic Act (RTA) of 1988 as well as a small additional list.
Following the requirements set forth by your insurer when an accident does take place is the best path to take to insure speedy processing of your car insurance claim. Most of the insurer’s requirements are in place to assist the insurer in determining the person responsible for the accident. Additionally, if the following steps are taken, it generally leads to a speedier processing of the car insurance claim.
These duties might include the following list, although they are not limited to these steps and might include additional ones depending on the specific insurer involved in the claim:
• The driver is expected to take photographs of the accident scene if possible. Perhaps he can use his cell phone, digital camera, or borrow one from an onlooker.
• The driver is expected to obtain the name of the police officer and the police station that he is assigned to if one is called to the accident.
• The driver is expected to take the names and contact information for any witnesses of the car accident, including passengers in either of the vehicles.
• The driver is expected to write down specific details of the motor vehicle accident including any related conditions of the area where the accident occurred. He should provide specific details including obstructions in the road such as animals, fallen trees, etc, weather conditions, and road conditions.
Any driver involved in a motor vehicle mishap should follow proper procedures for the speediest processing of any claims that he places with his insurer regarding the accident. Failure to do so can nullify his claim and destroy any chance he has of obtaining relief.
